Terms of Service

These Terms of Service (the "Terms") govern the conditions of use of the "Treasure Sleuth" (Treasure Sleuth AI / TreasureHunterAI) app, together with its related websites and all associated services (collectively, the "Service") provided by APPKEY LLC ("we," "us," or "our"), as between us and the customer who uses the Service (the "User").

1Scope

These Terms are intended to define the conditions for providing the Service and the rights and obligations between us and the User regarding the use of the Service, and apply to all relationships between the User and us in connection with the use of the Service.

2Acceptance of Terms

By using the Service, the User is deemed to have agreed to these Terms and to the Privacy Policy separately established by us. If you do not agree to these Terms, you may not use the Service.

3Service Content

The Service uses AI technology, image analysis, information organization, comparison support, and other features to provide analysis support relating to antiques, vintage items, collectibles, and similar objects, based on information that the User enters, captures, or selects.

However, the results, comments, estimates, price ranges, suggestions, classifications, cautions, and other output displayed by the Service are intended for informational and decision-support purposes only, and do not replace a formal appraisal, valuation, or any other professional judgment.

4Operating Environment & External Services

Some features of the Service depend on an internet connection, a compatible device, the camera, storage, external APIs, app stores, billing infrastructure, and integration with other third-party services.

To provide the Service, we may use external services such as the OpenAI API, RevenueCat, Google Play, and the Apple App Store. The User acknowledges in advance that all or part of the Service may become unavailable due to failures, specification changes, suspensions, restrictions, or similar events affecting these external services.

5Prohibited Conduct

When using the Service, the User must not engage in any conduct that falls under, or that we determine to fall under, any of the following:

  • Conduct that violates laws or relates to criminal activity
  • Fraud, threats, harassment, or conduct that causes disadvantage to us, other users, or third parties
  • Conduct that violates public order and morals
  • Conduct that infringes the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of us, other users, or third parties
  • Conduct that places an excessive load on the network or systems of the Service
  • Reverse engineering, decompiling, disassembling, or equivalent acts directed at the Service
  • Unauthorized access or attempts to gain unauthorized access
  • Improper use of the Service through bots, scraping, excessive automation, or similar means
  • Impersonating a third party
  • Conduct that may interfere with the operation of the Service
  • Any other conduct that we determine to be inappropriate

6Billing & Subscriptions

Part of the Service may include paid features, subscriptions, or similar recurring-billing services.

Fees, billing cycles, whether auto-renewal applies, whether a free trial is offered, cancellation methods, and other conditions shall follow the display in each app store, the purchase screen, or within the Service.

Management, cancellation, billing, refunds, and similar matters for subscriptions shall, in principle, follow the mechanisms and terms of the app store the User used for the purchase (such as Google Play or the Apple App Store). Except where attributable to us, we are not responsible for the app store's payment processing, refund eligibility, billing timing, or similar matters.

7Stored Data & Device Changes

Some or all of the history, settings, images, collections, analysis results, and other data that the User saves in the Service may be stored on the User's device.

Unless we expressly state otherwise, such data may be lost due to device changes, app deletion, device failure, OS reset, the User's own actions, or other reasons. The User acknowledges this in advance.

Billing status and purchase information may be restorable through integration with an app store or external billing-management service; however, this does not guarantee the restoration of the saved data itself.

8Intellectual Property

All copyrights, trademark rights, and other intellectual property rights relating to the Service belong to us or to those who have licensed such rights to us. Without our prior consent, the User may not reproduce, repost, modify, redistribute, or otherwise make secondary use of any text, images, UI, logos, programs, output, or other information provided through the Service.

9Suspension, Modification, and Termination of the Service

We may suspend, interrupt, modify, or terminate all or part of the Service without prior notice to the User in any of the following cases:

  • When performing inspection, maintenance, updates, or failure response for the systems related to the Service
  • When a failure occurs in communication lines, cloud infrastructure, app stores, external APIs, or similar
  • When provision becomes difficult due to force majeure such as earthquake, lightning, fire, wind or flood damage, power outage, or other natural disasters
  • When continuation becomes difficult due to laws, administrative guidance, specification changes of external services, or similar
  • Any other case we deem necessary

10Disclaimer

We make no express or implied warranty that the Service is free from de facto or legal defects (including defects, errors, bugs, or rights infringements relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, and the like).

Except in cases of our willful misconduct or gross negligence, we bear no liability for damages incurred by the User arising from the use of, or inability to use, the Service.

However, where the contract between us and the User regarding the Service constitutes a consumer contract under the Consumer Contract Act of Japan, the portions of this article restricted by that Act shall not apply.

11Changes to the Terms

We may change these Terms within the scope permitted by law when we deem it necessary. If there are significant changes, we will give notice on our website or within the Service. Unless otherwise specified by us, the revised Terms shall take effect from the time of posting or notice.

12Governing Law & Jurisdiction

These Terms shall be interpreted in accordance with the laws of Japan.

In the event of a dispute between us and the User regarding the Service, the Tokyo District Court shall be the court of exclusive agreed jurisdiction for the first instance.
